By downloading, installing, or using TextHerRight ("the App"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the App.
You must be at least 18 years old to use TextHerRight. By using the App, you confirm that you meet this requirement. We reserve the right to terminate access for any user we believe is under 18.
In compliance with FTC guidelines, we disclose that all coaching suggestions, conversation replies, pickup lines, date ideas, and responses generated by TextHerRight are created entirely by artificial intelligence (AI) — specifically the Anthropic Claude API. No human writes or reviews the individual responses you receive.
AI-generated content may contain errors, be contextually inappropriate, or produce unexpected results. TextHerRight is not responsible for any outcome resulting from your use of AI-generated suggestions. Always exercise your own judgment.
TextHerRight is an AI-powered dating coach that provides suggestions for conversation replies and openers. The App uses the Anthropic Claude AI model to generate these suggestions.
TextHerRight provides AI-generated suggestions for entertainment and informational purposes only. The content generated:
TextHerRight allows you to submit text, images (screenshots), and other content ("User Content") to generate AI coaching responses.
Your Ownership: You retain all ownership rights to User Content you submit.
License Grant: By submitting User Content, you grant us a limited, non-exclusive, royalty-free license to process and transmit your content solely for the purpose of delivering the requested AI-generated response. This license terminates immediately once your request is processed. We do not store your content after processing.
Your Responsibility: You represent and warrant that: (a) you have the legal right to submit the content; (b) the content does not violate any third party's rights, including privacy or intellectual property rights; (c) you will not submit content depicting or involving minors in any sexual context; and (d) the content does not violate any applicable law or regulation.
No Endorsement: We do not review, endorse, or take responsibility for User Content. We are not liable for any content submitted by users or for any consequences arising from third-party content submitted to the App.

We reserve the right to suspend or permanently revoke your access to TextHerRight at any time, with or without notice, for any of the following reasons:
Revocation of access does not entitle you to a refund of any subscription fees already paid. If your access is revoked for abuse, any active subscription will be cancelled and no refund will be issued.
All trademarks, branding, and original content within TextHerRight are owned by us. AI-generated suggestions are provided for your personal use only and may not be resold or redistributed.
The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the App will be error-free, uninterrupted, or that suggestions will be accurate, appropriate, or effective for your situation.
To the fullest extent permitted by applicable law, TextHerRight and its creators, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from or related to your use of the App, even if advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless TextHerRight and its creators, officers, employees, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of or access to the App; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third party's rights.
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App ("Dispute") shall be resolved exclusively through binding individual arbitration, and not in court. By agreeing to these Terms, you and TextHerRight each waive the right to a trial by jury and to participate in any class action or representative proceeding.
Arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, or a comparable arbitration body, conducted by a single arbitrator. The arbitration may be conducted remotely. The arbitrator's decision shall be final and binding on both parties.
Class Action Waiver: You agree that any arbitration or legal proceeding shall be limited to the Dispute between you and TextHerRight individually. You expressly waive any right to bring or participate in a class action lawsuit, class-wide arbitration, consolidated arbitration, or any other representative or collective proceeding against TextHerRight.
Notwithstanding the foregoing, either party may seek emergency injunctive or equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. To the extent any Dispute is not subject to arbitration, you consent to the exclusive personal jurisdiction and venue of the state and federal courts located in Delaware.
We may update these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms.
